Stallworth may be saved some by the fact the pedestrian was not in a crosswalk. There is obviously no excuse for Stallworth to be driving drunk, but my understanding is that if a pedestrian jaywalks and gets hit (in the absence of a drunk driver) the pedestrian is at fault.
Obviously Stallworth will be punished heavily (and should be), but I wonder if the pedestrian is partially at fault and that takes some of the blame off Stallworth

I am not defending driving drunk, but the amount of alcohol he had in his system equals about 2 and a half 12 oz beers. In my opinion, that is not driving impaired

I don't know where people get this. I used to keep a portable breathalyzer in my car (so I didn't end up like Mr. Stallworth). No way you will be at 0.12 after 2.5 beers unless you drink it in 15 minutes and then take the test.
But as someone said, the blood test was taken well after he hit the guy. If you drink 2.5 beers in an hour, drive around for a while, hit a guy, wait an hour for the blood test to be taken...you barely show up.

Not that it would have changed anything in the long run, but don't you guys have gum/mouthwash on you if you're going to be driving after you've had a drink or two? Even if I just have 1 beer after work I always have gum in before I start driving. It's just stupid not to.
Look at it this way - it was 7AM and Stallworth wasn't THAT drunk. If he hadn't had alcohol on his breath he could have maybe sold it that he was going to church or something. frick, it was Sunday morning was it not? They might not have even tested him. They probably would have given the circumstances, but who knows? Stupid to basically indict yourself like that and not even give yourself a fighting chance to skate.
As was mentioned, he PASSED THE FIELD TEST. Perhaps if he wouldn't have smelled like alcohol the officer would have forgone the blood test, or at least kind of had less urgency which would have allowed Donte's BAL to lower in time.

Before those annoying feminazis in MADD started gaining irrational amounts of influence over the law and politicians, he'd have probably been cool.
Pretty soon you won't be able to have a 2 for 1 happy hour after a rough day at work. It's ridiculous.

So basically if someone is not using the crosswalk, he is open game?

I am not postitive, but I am pretty sure that if you aren't speeding or breaking any traffic violations and you accidentally hit a pedestrian jay walking, they are 100% at fault. In fact, I believe you can sue them for damage done to your car.
Now you can't intentionally hit them, so no they aren't "open game"

How would anyone know if you intentionally hit them or not. Does clear or impaired view count?
How about if you have time to flash your bright lights at them but still hit them at 50 mph.

If someone watches you, sees you speed up and aim for the person all while flipping them off it probably constitutes intentional.

I am no lawyer and I am sure there is some grey area. But basically if you hit someone without breaking any laws and act in a "reasonable manner" the pedestrian is to blame.
