On Friday afternoon, Buffalo GM Buddy Nix and Tampa Bay GM Mark Dominik shot the shite for about six minutes. They talked about their impending free agents, their frustration with a new three-day negotiating window, and the major handicap of not having a franchise quarterback. They had no idea that a pair of pranksters had set the whole chat up, or that those pranksters were still on the line, listening in.

Can the pranksters get in legal trouble? I would think that in today's society they can be sued for SOMETHING, but what exactly? Is taping someone's conversation without their knowledge/consent some sort of crime? I know that's a dumb question but I have no idea.

it depends where the recording takes place. I know Maryland has very strict laws against it.

I know that recording someone in the state of FL without their knowledge is a crime or tort. Would just depend if the Bucs GM was in FL at the time.

So would it depend on where the pranksters were, or where the GMs were?

You could be in GA and record someone in FL and still be sued. I'm also not sure if it's criminal or civil.

Then again, why would a GM sue some 20-year old college student?

There is a criminal statute in FL governing this.

some states make it illegal to tape anything unless both parties agree and know its being taped. some states only require one party to know its being taped. I would think these dudes are fried regardless of what states are involved.

That part of it is fine. You just can't air it publicly without consent.

When I worked in commercial radio and we did phone pranks - We were required to call back the people we pranked and get their permission to air the calls. Sometimes we rolled the dice and just aired them or got really crazy and rolled live... but we would've been in DEEP shite if anyone involved decided to do something about it.

ETA:

It's possible Deadspin will be picking up the tab on this one... maybe even youtube.

I know journalist have to ask permission of someone to record anyone their interviewing, so I'm thinking you have to have both parties permission
