Louisville student who hit halfcourt shot will not receive 37k in winnings

Kid wins one of those contests by making layup, FT, 3 pointer, halfcourt.

But days later UL announces the student is ineligible because of a sub clause within the 5 page contract, regarding student is ineligible if they played HS basketball.

Pretty shitty IMO. I doubt the kid knew about that clause or why else would he even do it. I understand a contract is a contract but it's 37k not 500k, this makes you look cheap AF as a big University. They did say they would pay for his books and a meal plan -

Maybe UL had a contest insurance policy covering it and the insurance company is refusing to pay- but the college should nut up and pay. Also what a dumb fricking clause- why not further limit eligibility it to only mouth breathing, wheelchair bound fatties?

Apparently he couldn't even play basketball within the last six years. So if he had been a freshman in college, he couldn't have played AAU, optimist, or even middle school basketball.

Who didn't play one of those at some point between middle and HS?

ETA: The story here was that the contract stated organized basketball. So I believe it went even beyond HS basketball. But that was reported by another local station.

ETA: To be fair, the contest was run by a third party. Louisville isn't really the one taking a hard stance on the issue.

Maybe someone with a better understanding of contract law could help here, but would he have any case at all?

It's clear based on the contract that he signed, that he is ineligible to win

It depends on what exactly the contract looked like and how obvious that term was. If it was buried on like page 4 of a 10 page contract and all he had to sign was the first and last page he might have a case.

There are a few different doctrines to protect individuals who don't have contract expertise from taking being taken advantage of by big entities sneaking overly onerous provisions into big contracts. It sounds like it's at least worth getting a Kentucky lawyer to look into it, but it doesn't sound like a great case

Nah, it's pretty standard to not investigate a claim until you're forced to pay for it. Think of it like life insurance - they'll freely take your premiums, but if you die suddenly they'll make sure you were eligible for the coverage in the first place.

Long, doubt he had access or time to read it all...There are issues to argue...

Unconscionability...He had no ability to negotiate, can't have played for 6 years??? That excludes most males in America...Contest was a fraud designed to nullify any winners and used only for free marketing.
