When you are falling-down drunk, and your "designated driver" has been arrested, then what to do? Let them walk away? They are a danger to themselves, hence why they are taken into custody.

Was it his car?
I think Steve McNair got nailed once for being a passenger because he was allowing a drunk to drive his car.
