Brady won an appeal case but later lost NFL appeal. Elliott will eventually serve this full suspension just like Brady.

Purely speculative and hypothetical, but had Brady applied for a writ of certiorari and the SCOTUS granted it, it's very probable he would've lost bc SCOTUS was(and now is) 5-4 conservative to liberal then and the conservative justices would've deferred to Art 46 and the 2011 CBA bc contract law, free market logic and judicial restraint as pertains to such subject matter.

It's actually an OK point by him in the sense that even with the NLRA, LMRDA, and all that, the NLRB tries not to get involved in grievance issues and defers them to the arbitration process whenever possible ( link). But, sometimes guys' "section 7" labor rights are affected to the point they can't avoid getting involved. All of that said, the courts are the mechanism to appeal/enforce grievance matters. I could see the courts do a similar thing here as they did with Brady and just say the union gave away all this power in collective bargaining, we're not messing with that process. But, at some point, Goodell is going to really push his limits and a judge/appeals court will be creative in finding a way to smack the league down.
