The poster makes a valid point. Clearly Smoke had no idea anyone was walking on the track. He was just warming his tires on dirt when he swerved at the exact moment someone tried to taunt him for punting him off the track.

No shite, it ends with him getting hit by a car after his dumbass runs in front of it. Stewart could have done it on purpose, but you could never prove it. All that matters is Ward got out of his car and moved into Stewart's way. A lawsuit should get them nothing. Ward did it to himself.

Ward did it to himself, and you could never prove Stewart did anything intentionally. It is a complete waste of everyone's time to take this suit to court. It is the very definition of frivolous.

It isnt frivilous in the least for a civil case. If only the jury thinks 1% is Stewarts fault then Wards family will be awarded money. This case is anything but frivilous.
