So my wife recieved a form SSA 1099 through her mother's address after we already filed and recieved our return.

It says it is for benefits repaid. Everything I have been reading sayd that the form is for benefits recieved.

What info can you guys give me and do I need to amend my return or not.

Did your wife receive SSA benefits in a prior year? That she had to repay in 2015?

Her mom has been paying something for the last few years she said.

Is this to show it was being paid?

How old is your wife? Did her dad die and mom was claiming benefits on your wife when your wife was a minor, and the benefits were overpaid to your wife as a minor, so now mom is repaying them?

She is 27 her dad passed 3 years ago. I guess some money was sent that wasn't supposed to be maybe?

It does say money was repaid in one of the box's and it has none in the money paid box. So I think she must be paying some back for whatever reason

If a 24 year old got any money from the SSA, it probably all needs to be sent back.

You said the 1099 went to her, but sent to her mom's house?

It sounds to me like when dad died, someone applied for benefits on her behalf, which she was not entitled to. Once SSA caught on they asked for it back. I'm assuming your wife never saw any of the money.

If at some point she had to pay tax on that money, the fact that it is being repaid should mean that she could take it as essentially a negative income now.

There are some other comments I could make about why she didn't know an SSA claim was filed on her behalf but I'll let you figure that one out.

We got it figured out. When she was younger her father got SSI, when he passed her mom went to SSI and found out there was over payment to her and brother.

Her mom is paying it back because she says it's not the wife's fault.

Now looks like I have to send in an amended return, correct?

All depends on the amount of the repayment.

$3k or less would be a misc. itemized deduction subject to 2% of AGI

$3k or more you can claim an itemized deduction (not subject to 2% of AGI) or claim a tax credit for the difference between recomputed tax w/out the income and the actual tax paid during that year

Unless you itemize and your AGI is $15,000 or less, you wouldn't receive any tax benefit.
