The only thing that throws me off is the "effective April 30, 2012"???????? Why is this? It begins after the date in which 2011 taxes are due??? Doesn't make sense to me...

Correct me if I am wrong but the emergency rule goes into effect on this date. I wonder if those who applied before are grandfathered in?

Roof, I don't know why they are giving you trouble? I would drive to Baton Rouge and settle it if I were you...

My return was pulled for audit. But it was submitted feb 12th and my refund was issued on 3/29. Plus i have E85.

I'm not a lawyer by any means so I'll defer to the legal community. It's definitely laughable that the State is b/c they got manahandled on this credit.

Duck, i could never get anyone on the phone that knew about the emergency ruling. I left voicemails in several areas. Nobody could address my issue....

Don't give up so fast! The original law was written in 1990 or 1991. It was repealed and replaced in 2009 by R.S. 47:6035.

I was told by DOR's customer service department about a month ago "also file amended returns for your clients who purchased flex fuel vehicles in 2008 so they can get their $3,000 refund. You have until May 15, 2012 to file them."

I agree that 2008 returns can be amended as long as they are filed with the State on or before 5-15-12 as you always have three years from the due date of a return to file an amended return for an additional refund.

What I don't agree with is the $3,000 amount as the old law's credit for vehicles since 1990 (or 1991) was 20% of 10% (.02%) of the cost of the vehicle or $1,500 whichever is less. A vehicle would have had to have cost a taxpayer $150,000 to get the $3,000 credit and then the credit was limited to $1,500 anyway but I kicked that in just to show how screwed up this whole situation is......but, who knows how much the LA DOR will give you for your 2008 flex fuel vehicle....seems they have too much money and need to get rid of it some type of way.

In all seriousness, file your amended return for 2008 with the proper documentation and claim the $3,000 credit as instructed by their customer service department. All that can happen is they reduce your refund to .02%. Example: $35,000 x rate in effect for 2008 vehicles .02 = $700.00.

Be sure you either hand deliver the return and get a receipt for the delivery of your 2008 amended return or mail it certified, return receipt requested no later than 5-15-2012.
