Car insurance claim question

Was recently involved in an accident. It was other person's fault. My vehicle is chevy silverado.

I filed a claim with other driver's insurance(Liberty Mutual). After 2 weeks, I get a call from Liberty Mutual. Claim adjuster said that the truck is totaled. Market value of my truck is 11.5k. She said because I didn't try to get out of the way or beep my horn, Liberty Mutual is only responsible for 80% of the damages. Is this legit?

Any how, 80% of the 11.5K is around 9200. She said that they'll cut me a check for 6500 and I can salvage the truck for the remainder of the balance. Does this sound right?

Am I getting screwed by liberty mutual? What's my recourse?

If you have collision coverage, file with your own insurance company and let them go after the other party's insurance to recover.

Depends on the circumstances of the accident as to any comparative fault on your part. Blowing your horn to alert a distracted driver thats hits you when you have the right away does not bring you into a faulty position. If you were not a 100% in a legal position when they hit you then you may share some fault. Insurance companies are bean counting weasels and will try and nickel and dime the uninformed and weak. If they totaled your vehicle you are due the retail value plus the tax on that value. They cannot force you to buy it back for salvage. It sounds like on the surface of the limited info that they are playing games with you.

First, why in the hell do you not have collision coverage on a vehicle worth $11,000?

Second, she's trying to pull a fast one on you. Tell them if they don't repair the truck or give you a check for 100% of the value of the vehicle that any further communication will be via your attorney.

Also, next time you don't need to share any information with the adjuster other than what's in the police report. So when they ask you if you attempted to avoid the accident or honk your horn tell them everything they need to know is there.

i was going west. other driver was going east. At the green light other driver attempted a left turn. Police report said it was 100% other driver's fault.

You aren't getting $2800 scrape for your truck. Maybe $500 if you are lucky. Don't take a dime less than 11.5k.

So the police report says fault 100 percent on their insured, but they say 80%?

I'd tell them you expect a check for full market value plus tax. I'd suggest to them if they are interested, they could sell it to a scrap yard for salvage and recoup some of their money.

The problem here is I'm not sure how much an attorney would charge here, and if you have to pay the attorney several thousand dollars, you are going to get screwed either way.

If you have an attorney friend who owes you a favor, this would be a great time to call it in!!

Aren't you the same guy who just a few weeks ago said that he didn't carry health insurance because he was young, healthy and didn't worry about getting into traffic accidents? Consider yourself lucky that you weren't injured.
