I have a balance due of $3,000 on my account. Told me to take it up with their policy division

I would tell them that you need it in writing to give to your lawyer.

Duckslayer i bet none of you guys before me have to pay your money back. My return was valud as of 2/21/12 with all proper documents. They held it long enough to make an example out of me. Now i have to make sure i get all of their money back to them. bullshite!

They will go after all. I have seen them go after money nearly 3 years after filing. Duckslayer is next!!!

The auditor said she was told they were going all the way back to the start of the credit ie 2008 or 2009. However she told me the policy rewrite was not yet posted and then i adked her again if everybody would be treated equally. She then referred me to the policy dept. she didnt answer me the second time. I AM VERY UPSET ABOUT HOW I WAS TREATED THE LAST 2 months by them. They put a balance due on my account treated me like a criminal, and took a valid credit away from a louisiana tax payer the same week he was given a credit. They then changed the rules all of a sudden.

They can't change the "policy," its a state law.

Maybe you need to hire a lawyer.

Cost me a lot to try to fight this wirh a lawyer? Still dont know why the state is after me.....

Roofdog, there must be others who have posted that they received the credit on this website and now have gotten a call like you (or notice). This seems odd that you are the only one who has admitted to this so far. I'm sure you filed in the same manner as those before you.

Makes you want to try out your skill on a kimura or anaconda choke.

Pecanman, i applied for this credit because i did extensive research. I posted updates because i am the only one who is experiencing problems with the process. I did my return under good faith based on the policies and laws. I did not have any unethical intent. I think i have been singled out for whatever reason as for as my return goes. Guess its the luck of the draw.

Roofdog, I don't think you have been singled out. I believe that all 71F credits will be re-examined. We will find out. Someone on this medium might be next (like I joked with Duckslayer). I actually filed a few amended returns in good faith, too, based on what information I was receiving but always had some doubt about it. I have not heard back from my clients. It has only been about two weeks since I prepared the amended returns. I have gotten emails from the state recently after asking them about their position and their last email was that Flex Fuel vehicles were under advisement. You have given the latest update. Anything new that I find out I'll post.

Tell the auditor you want to appeal the determination.

Rights of the Taxpayer

Or you may just want to wait for someone else to appeal the determination. If they start denying the credit, there will be quite a few appeals.

What's the process for filing a public records request? It would be interesting to review the intra-office communication on this issue.
