Absolutely. I totally agree with you but also know that at his level of intoxication that he most likely wasn't aware, and will not remember any of these events. Not defending his behavior, just offering a possible explanation.

He STARTED drinking at .000


Stop acting like his blood alcohol spontaneously became .333 without him placing a drink (or 20) to his mouth and swallowing

When you are driving a 5 year old child around. YES!!!!!!

ETA: You cannot DECIDE to get wasted and then use the "I was too wasted to know what I did" defense with me.

FWIW - I don't have a problem with a .003 while driving. That's about where 1 drink an hour on a non-empty stomach puts an average-sized guy.

regardless of the situation, when you are with your 5 year old kid, your BAC SHOULD be .000


Really there isnt any excuse why you should be drinking with your 5 year old kid with you!

Maybe thats just how I was raised.

I arrested a guy once that blew a .24 and he was hammered out of his mind!!! The guy could barely speak... A .33 DAMN!!!!!!!

Shrubman says you should NOT have arrested him since you do not know if he may have gotten too drunk to realize that he should not drive. Thus, he is not to be held responsible for driving while drunk.

You are fricking nuts, and pretty ignorant as well. Link to where I am excusing his actions.


No wonder people think southerners are simple. A possible sequence and explanation was given as to how he may have gotten to that point, no excuses were made for his behavior. He is totally guilty and should face all charges.
