Well my argument is that it's a fundamental right no matter what any government says. The right to consent along with another consenter to a social union--or a marriage, as is the definition of the word--is a basic right that no one will dispute. When two unite in this way, there exist natural and logical rights, some inherent, and some established between the two (property, children, inheritance, etc). Our Government is charged with protecting our rights, and that includes marriage rights. For the State not to protect the marriage rights of two people regardless of the sexes of the married is a violation of a basic right and due process rights (this is where your take and mine align, I'm guessing--equal protection).
