I'm torn on the McQueary situation. This guy grew up right near the campus. His dad was friends of all the coaches. He played for Joe Paterno and Jerry Sandusky. He was now on the coaching staff with these guys. He was very young in his coaching career when he witnessed this. I'm certain he was in a state of shock. He probably wanted to slow things down and make sure that his next step was going to be the correct one. I don't have a problem with him talking this over with his dad. He brought the information to the most powerful man on that campus. He trusted that Joe Pa would do what was right. I think within the law, McQueary is definitely covered.
However, I also don't understand how he didn't help stop the "act" in the shower to help the young boy. Even if I can get past that, maybe he was shocked and scared and didn't know what to do. How could he stay on coaching at Penn St when he saw Jerry Sandusky freely roaming the halls at the Penn St football complex, and knowing that he had access to hundreds of young children? At some point you have to make a stand and separate yourself from what was going on there.
However, I also don't understand how he didn't help stop the "act" in the shower to help the young boy. Even if I can get past that, maybe he was shocked and scared and didn't know what to do. All the hate for him not doing anything more is absolutely justified.
But it has nothing to do with his suit against Penn St. He's going to get paid.

Within 2 months after he saw what Sandusky was doing to that kid, he was Sandusky's golf partner at an event.

Wrong.
Sandusky continued this for years after this incident. One of the boys coming forward is the biggest reason Sandusky was arrested and convicted. If McQueary deserves any credit, it's for being the best link to showing that his happened for years and was covered up. That's about the best that can be said about McQueary.

If this is true, then McQueary is the biggest chicken on the face of the planet. I think what he did was worse than Petrino and I'm not convinced that he didn't downplay what was going on when he told JoePa. I hope McQueary lives a miserable poor existence for the rest of his life. he probably had dozens of opportunities to come clean and prevent that predator from hurting another child, and he just turned the other way and kept collecting paychecks.

But he didn't blow the whistle? He went to coach Paterno and tried to use the information as leverage to get a job as a Penn State coach. Actually the University should sue him because he did NOT blow the whistle.

He was already on the staff as a grad assistant. He grew up in State College, and his dad was friends with the coaches already. He played QB at Penn St for crying out loud. The guy didn't need to "blackmail" Joe Pa for a job, he was already in the clique.
As stated by law, a person should report a crime to their superior. A grad asst reporting to the head coach would easily qualify for that.
Strictly in the legal sense, McQueary is covered.

Not sure how he qualifies for whistleblower protection. He kept his mouth shut for 10 years and only talked when the grand jury found out from other sources and started investigating.
He has no reasonable expectation of continued employment. When you're an assistant coach and your boss gets fired, the new guy is usually going to bring in his own people.
And he has no reasonable defamation claim. The reason his reputation is shot is because he saw a child being raped and didn't intervene.
If he does get anything out of this lawsuit, I hope Victim #2 turns around and sues him and takes every penny of it.
