And provide ammo against the mandate (and the vaccines).
Biden is trying to use an Emergency Temporary Standard to impose the mandate immediately upon publication of the Rule in the Federal Register. That Reg states:
However, it also looks like the vaccine itself would fall under the definition of a hazardous substance...
LINK
Notwithstanding that the "vaccines" have directly killed tens of thousands worldwide (and these are conservative numbers), even for those it doesn't kill, it absolutely poses a defined and recognized risk of myocarditis and clotting issues at a minimum.
In other words, the very rule they are relying on to require the jab can be used against it.

quote:
In the original final rule for HAZWOPER, the language in question was incorporated by reference to section 101(33) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) of 1980. To improve clarity, the pertinent language was incorporated directly into the HAZWOPER standard on April 13, 1990, under subparagraph (B) of the definition for "hazardous substance," which reads:
Any biological agent and other disease-causing agent which after release into the environment and upon exposure, ingestion, inhalation, or assimilation into any person...will or may reasonably be anticipated to cause death, disease, behavioral abnormalities, cancer, genetic mutation, physiological malfunctions...or physiological deformations in such persons or their offspring.
As implied by the plain language of this definition, the phrase "other disease-causing agents" refers to any substance not otherwise covered under subparagraphs (A)-(D) of the definition, which causes death, disease, behavioral abnormalities, etc. Correspondingly, crystalline silica, which as you mentioned, causes silicosis and is not otherwise covered under the definition for "hazardous substance," would be considered a hazardous substance under the criteria established in subparagraph (B). Conversely, heat would not be covered under this definition, since heat is not a substance but rather a form of potential energy.
Emphasis added.

Biden has no clue, he just reads his teleprompter so he can get his pudding reward.

They’ll twist and abuse any rule to get what they want. Look at Roe vs Wade, or ACÁ.
The whole system has been throughly corrupted, and I don’t trust the courts to follow the law.

so how in the frick if it is an emergency can you let in untested, unvaccinated people across the border? Make that part of the lawsuit.

Did you gripe about any instance you perceived this happened?
Why not now?
I can’t imagine how helpless Dems feel in supporting this abject failure. Has there ever been a president that admits he has to get permission to answer questions? It has to be embarrassing.

I've dealt with CERCLA projects (off and on) for decades.
The whole concept using CERCLA for vaccinations is stupid. It's like using a hammer to polish your car. It was never in any way Congress' intention for to be used for something like this.

The unvaxxed are the toxic agents. They will not focus on anything else because they don't want to.
They will extend the emergency as long as necessary to get what they want.
Lawfare been putting in the overtime to find ways to "legally" frick us.

Seriously doubt they'll be entitled to Chevron deference.

Never depend on government to stop government overreach.
In fact, assume that government will say the sky is purple, laugh in your face and jack off on the bodies of dead babies.

1. Trump ordered White House Counsel Don McGahn to create a false record indicating that no attempts [to fire Robert Mueller] took place – McGahn refused.
2. The Constitution’s Foreign Emoluments Clause prohibits the president from accepting personal benefits from any foreign government or official.
Trump retained ownership in his family business while he is in office. Every time a foreign official stayed at a Trump hotel, or a foreign government approved a new Trump Organization project, or granted a trademark (Chinese granted him several trademarks), Trump is in violation of the Constitution.
3. Every time Trump went to golf at a Trump property, he funneled taxpayer money into his family business, violating the Domestic Emoluments Clause.
Trump spent over $100 million taxpayer dollars to golf and vacation at his own properties.
How would you feel about Joe Biden funneling $100,000,000 plus of taxpayer money into his personal business? I'd like to see you go on record here saying how you would feel about that.
These are just the tip of the iceberg of ways he either violated the constitution or broke the rules.

Could lawyers parlay this into a challenge on Chevron Deference? That’s the real question. Libs are known to throw a boomerang in their face from time to time.

This will explode in his face just like every other major decision he has made

You mean, like using the Clean Air Act to regulate Greenhouse Gases. Square peg round hole is what Democrats do. Keeps them from having to pass legislation.
