Ah the reconstruction amendments. A brilliant example of politically motivated and stupid short sited measures by big government democrats aimed at addressing a symptom of a problem instead of the problem itself and having massive far reaching detrimental effects to the country that have nothing to do with the legislative purpose in the first place.

There is still room to debate the constitutionality of birthright citizenship.

For example. The children of diplomats born in the US are not granted Citizenship.

No. It's not. At all, actually.

In fact, there's a clear question as to whether it is legal or required under US law. Supreme Court has NEVER ruled on the issue (other than a passing footnote in Plyler v. Doe, which is dicta).

One thing you learn in dealing with contracts or law is there are no "extraneous" words. Interestingly, the 14th Amendment does NOT say:

The 14th Amendment says

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
That phrase is a troublesome little thing indeed. It is especially troublesome in this environment of courts refusing to strike down sanctuary cities, forcing release of illegal aliens, and otherwise implying our domestic laws do not fully apply to illegals.

Two folks show up at the hospital, running from police and injured. They will get reported and turned over. OTOH, two illegal immigrants running from ICE, show up at the hospital to have a baby. They will not get reported and turned over. In fact were the facility or individuals in it to try turning the illegals over, they would be subject to legal retribution.

Obama signed an executive order which said he would just stop executing immigration law, and created a new class of citizens altogether.

I am not sure this is really so clear. A statute could pass constitutional muster. I am not sure this is so clear.
