That's debatable, or at best, not quite as obvious as you make it out to be.

Also, if the speed limit is 70 and I'm going 75-80, I'm not going to slam on my brakes down to 50mph to try and squeeze into a small window of opportunity to switch over. So yea, technically I can move over, but I'm also passing cars, ya know, which is what the left lane is for, so that's still using the left lane as it is intended.

Then you are in the right.
But if you are in the left to pass a car in the right 500 feet ahead you are in the wrong.
