This is getting into muddy water, Comey as FBI director certainly had some discretion to make that determination. However, as a private citizen, it was no longer up to Comey to determine if those documents could be released to the public. Also, notice, he didn't release the documents. He described them to a 3rd party that took it to the press. He was certainly running a very thin line.
