This is exactly what the problem is...it is illegal to produce, sale and distribute but it is overlooked as long as the sales are small and quite. Thats for pot, cocaine and similar drugs are not sold in coffee shops....they are as illegal in the Netherlands as they are in the US.
The problem is that people want to get stoned and people want to make money fcailitating that....but the state wants to prevent it when it should apply sensible regulation and tax the industry and get on with life. No one in Amsterdam is being beheaded because of beer....but put beer into a legal limbo and people will start shooting one another and you will have the same situation.
