Technically he's still a juvenile under the law at 17. Unlike rape laws, where most states have amended to include specific rules for the 14-18 year old group, there is no such clause in child porn statutes. The MS statute has no qualifying age before it applies, so technically a 12 year old can be charged with possession of child porn. Her age would be irrelevant in MS. Again, I'm not sure about LA laws. They're both juveniles. If your going to charge one, you need to charge the other.

So if a 16 year old has nudes of herself on her phone, she can be charged with possession of child pornography?

This does not surprise me in anyway what so ever. We moved up here a few years ago and I have never seen anything as racist as this place.
