I would guess that it is a rights issue, I think in the pilot they only show some red boots or something, don't remember off the top of my head. they never say his name so it might be a rights issue.
If they do have the right then they may have to pay to use his name versus getting the super girl name cheap.

I watched the pilot and the ways that they refer to Superman didn't stand out as "avoiding" anything. I'm pretty sure that they did say Superman at some point. If they didn't, they did it in a fashion that was so seamless that it didn't stand out as avoiding anything.
This isn't a Superman series, so don't hold your breath for him to show up.
It was a fun pilot. I'd especially recommend it to folks with kids. I'd think that young girls would love this series.

Warner Brothers own D.C. and makes every single show that includes a D.C. character. They sell those shows to the various networks (CBS, Fox, and CW). So the creator of Supergirl owns Superman. It is not a right's issue. It is clearly a creative choice.
