Renters rights

Anyone know anything about renters rights regarding mold in the home. I'm looking at breaking my lease and moving but want my deposit back. I am also thinking of with holding any further rent payments until he replaces things and cleans it up. It's pretty bad. I've purchased a mold kit and have had a couple of contractor friends take a look at it and they def think its bad. Anyone else gone through this? After Katrina I'm sure there has to be lots of cases. Thanks on advance folks!

FYI, there are tons of different kinds of mold so don't freak out as it's not all toxic.

I posted about this a while back in another thread

FYI not all molds are dangerous and not all black molds are dangerous. Cladsporium is pretty benign compared to stachybotrys, and they are both "black mold."

Get certified docs saying it's the bad kind. Present the docs to landlord. Give landlord chance to rectify situation. If landlord doesn't rectify then move forward with your plan.

I rented a house off Violet street a few years ago, it had a leaky roof. Started molding on my third story loft room ceiling pretty bad by spring, similiar to this:




I told the landlord about it, come back form school a few days later to find that it had just been painted over. She says she "fixed" it. I left, never heard from her again.

If you sample for mold you will get mold. If you're sick it might be worth speciating.

Where in the apartment is the mold?

Yeah, good luck with that. Tenants have a very difficult time prevailing over landlords. Landlord has a signed contract. What you have is what you say is mold.

Having just taken my property exam two days ago, I can tell you this is a really easy case. Since I am not yet licensed to practice law, it is illegal for me to offer you advice. Also, anyone who actually knows the answer probably isn't going to give you free advice. You clearly have no idea what your rights and obligations are, so go see a lawyer.
