I'm still not 100% sure it would be legal to just destroy it, just because someone else may be breaking the law I'm not sure you can destroy their property. I'm trying to think of a parallel.

This. Even if someone is being a nuisance, you'd typically not allowed to destroy their property.

I guess it would fall to the totality of the circumstances to really come to a decision. I don't envy someone who would have to decide that one.
