Need an Attorney regarding neighborhood by-laws

My neighbors and I are in a dispute with the developer of neighborhood and a builder who is buying up lots to build houses that do not meet the standards set forth in the by-laws. The neighborhood does not yet have an HOA formed and is just over 50% occupied. All of the current occupants want to do something in regards to stopping them from filling the neighborhood with houses far below the value of the existing homes. What are our options? We are ready to seek an Attorney. What type of specialty should we look for when seeking legal council and does anyone have a recommendation in the Baton Rouge area?

I wouldn't discuss that on here.

Look up real estate attorneys. If there are binding by-laws then he can get an injunction to cease the building until it gets solved or goes to trial. Prepare your assholes for a good stretching.. these things tend to drag on.

1) There is nothing wrong with a builder putting home of differing values in a neighborhood.
2) As mentioned, this is probably not the best place to discuss.

This is so not the place for this. Phelps Dunbar has probably already started screen capping.

Even when people bought after reading the by-laws that disallow it?

They are proposed bylaws until officially adopted by an association, right?

What do you mean when you say set forth in the by-laws since the HOA isn't set up yet. Who wrote the by-laws and is there any way for the builder to have notice of the by-laws?

Don't know. Do the buyers have to sign something acknowledging them and pledging to follow them at the time of sale?

What are the zoning regulations in the neighborhood? Does the zoning allow for smaller lots?

The developer wrote the by-laws but he has fallen on hard times and is selling out. The new proposed construction that is being advertised does not meet the construction/design requirements in the by-laws.

Consider selling. It's going to get shitty.

quote:No. They are legally binding by-laws set forth by the developer. He controls it until he hands it off to a HOA with an elected board. (Unless this neighborhood is a debacle from the start). That's how its typically done.
