Reading that statute, it looks as though the girl could be charged as well, if she is the aggressor. Of course, we haven't read any of the supporting/defining case law, but the "either person" phrase seems to suggest it.
The "in the presence of" phrase would seem to qualify the arrest of everyone at Mardi Gras.

He's right, it's f*cked up and blaming Lowe or 99% of non criminal men who would do this in a second and get fooled is a ridiculous loophole that has no basis in common sense.
