1. your "rights" are basically positive or negative. Protections from the governments or guarantees of something from the government. Privacy is most certainly not a guarantee, so it is a protection from. In this case, the government had nothing to do with it.

You're assuming that constitutional rights are the same as legal rights in general, to say nothing of moral rights.

I know some disagree but I find it hard to have liberty without privacy. Certain elements of privacy are explicitly protected such as beliefs (1st) housing (3rd) person (4th) self incrimination (5th) and others I think are properly inferred from the 14th as it reads:
