According to The Sun Chronicle, Murphy and the victim met for the first time during the Xfinity Center Amphitheater show, where both had been drinking alcohol. After making out by a concession stand, Murphy led the girl away from her friends to the lawn where the assault allegedly occurred. Assistant District Attorney Melissa Tafe said the girl told police “she was afraid of what would happen” if she didn’t go with the defendant.
The onlookers apparently did not realize they were witnessing a rape until a woman asked the girl if the act was consensual. When the victim replied no, the woman pulled Murphy off of her and went to the police. Police locked the venue down and located Murphy in the crowd. They also obtained some of the footage and images taken by bystanders as evidence.
Murphy has no prior arrest record and lives with his parents, who are expected to post the $10,000 bail for his release.
The lawyer for the defense released a statement questioning the allegations.
“Put simply, this was a consensual act, not a sexual assault,” it read. “There are no allegations of force or violence against him. This was a private act that regrettably occurred in a public place.” Murphy will appear back in court on September 25th.

Interesting. If they have video, there is no force, and she never says no or refuses until asked by a bystander, what happens?
