Harry Reid's nuclear option to appoint Federal judges pays off.

Well, it's likely to pay off when the full DC Court of Appeals reverses the absurdly hackish decision released yesterday by two Bush partisans.
The three judges appointed after the Senate rule change away from the previously required 60 vote super majority means an 8-5 majority of Democrats to Republicans on the full panel of voters who would issue the en banc decision.
Reid's rule change might have saved another US Supreme Court deliberation of Obamacare, too, since they are far less likely to take on a case where there is no disagreement among district courts of appeal.

You are so shortsighted.
And stop upvoting your own posts. It's unseemly.

It's actually 7-4, Rex. You should get your facts straight before gloating.

Only a complete moronic partisan hack could actually come out with an opinion that says "a State exchange" does not mean "a State exchange" -- like the 3 Dem appointed (2 by Odummy) intellectually and morally bankrupt scumbags on the 4th Circuit.

So are you saying that Obama appointed judges will rule based on partisanship and not the plain letter of the law?
ETA: Obamacare only mentioning that only state exchanges are eligible for subsidies is just a drafting error, right?

Yes, it might have paid off.
Lord knows we need more judges who claim that they can't comprehend plain language so that they can insert whatever their favorite party needs at the moment.
Congress and the voters be damned.

Yeah, ruling on what the English language says is written the legislation is hackish.
And of course Reid's nuclear option is paying off. That's why the went down that road. They saw this case coming.
Regardless, SCOTUS will end up hearing this case and Roberts will get a chance to redeem himself. It only takes four justices to bring it up to SCOTUS, and you know what four those will be.

Great. You admit that Reid's action effectively took the blindfold off the scales of justice, yet you rejoice.
Typical progressive hypocrisy.

I wonder if you will be as supportive of the nuclear option when the other side uses it in the future.

But, the 3-0 decision where the judges found there to be "ambiguity" in the plain language that limits subsidies only to persons using exchanges "established by the State" is not hackish?

Why does party matter for applying the law?

"Far less likely" - no. Less Likely, yes.

On June 14, 2005, the Senate confirmed Griffith by a vote of 73-24. Twenty Democrats joined fifty-three Republicans in voting for Griffith’s confirmation. Next.

Rex I am sure you won't complain once when the R's have the Senate and use this option, right?
Posted on 7/23/14 at 1:19 pm to Rex
I bet you will be singing a way different tune if the senate is 51/49 GOP with a GOP president. I hope the next guy nominates Robert Bork in that scenario.

Chicken needs to institute a mercy rule on voting.
Once any post has a 45-downvote margin, voting stops.
Seriously, 72-6 downvote?

From 2006
quote:
But Democrats contend that the Republicans are essentially breaking the rules to change the rules. "If there were ever an example of an abuse of power, this is it," said Senate Minority Leader Harry M. Reid (D-Nev.). "The filibuster is the last check we have against the abuse of power in Washington."
