To me, that's pretty simple.

Aereo is giving Fox another go at it, but it's not the same case at all.

If Fox has a contract with DISH that states the above, I have no clue how a judge could rule in DISH's favor.

It's about the agreed upon contract ONLY. Nothing more, nothing less.

Dish is retransmitting nothing. The consumer is retransmitting the content he is already paying for using the home network he also owns. As pointed out above, anyone can buy a standalone Sling & do essentially the same thing.
