You still haven't given us many details. Is she spending hours searching for other jobs while on the clock? I doubt somebody has watched her constantly to be able to prove anything. If another employee saw her on a job search site, that doesn't really tell you much. If she spent 10 minutes out of her day to look for a job, who cares? Unless she is falling behind in her work...

And using company equipment? Are you really making that big of a deal about this? I doubt she's costing the company more than pennies on the dollar by using the equipment to look for a job. You make it sound like she took a company car for a joy-ride or something. Do you check personal email at work? Do you look at TD? That's no worse because you are doing personal things at work, which should all be treated the same way unless we're talking about porn or something illegal.

And you're posting personnel matters about a subordinate and inquiring about advice on discipline from strangers on a public message board.

At this point, you're just as wrong as she is, perhaps moreso because you're held to a higher standard as a manager.

I keep all personal related issues separate. None of my friends or family members have my work phone number. If there is something that I need to look up, I use my iPad or personal cell phone.

There's the problem right there. You're not satisfied that she's managing her area properly. She's not coming to you with solutions, only problems. Now you want to use the "looking for another job" as a reason to write her up. Why don't you write her up for not fixing the damn problems in her area?

I don't think it is easy for will to fire this employee. Seems like he could have a potential "wrongful termination" suit on his hands. And he just gave this chicks lawyer all the ammunition he needs with this post if she finds out about it.

If I was Will, I would let this slide and hope she produces…he picked a wrong battle to go after her with.

So you are doing personal things on company time. You are making a huge deal about using your personal ipad vs using your company issued laptop to look up something? Do you realize how ridiculous that sounds?! If I was your manager I would be more concerned that you are taking more time to switch to your ipad rather than just look up something on your work computer.

If this is your mindset, I have a pretty good idea why she is seeking employment elsewhere.

I wouldn't worry too much about discipline or about replacing her. I'd start thinking about how to replace her replacement. They are going to be looking around soon enough.

And yet for someone so allegedly buttoned up in terms of professional conduct, you're posting personnel matters on an SEC sports message board and soliciting disciplinary advice from absolute strangers?

No offense, but if I'm your manager and I found all of this out, you're the one who'd be on the chopping block. Talking about company matters and asking for advice on disciplining subordinates on a message board >>>>>>> using company time/equipment to look for another job.
