Tenant in my rent house sent this to me. How fricked am I? No termite contract.

Really need a frame of reference for size ( coin or something).
Most all the termites I've ever seen were small, like the size of a grain of rice or smaller) and they were a very pale tan, mostly white color.
Can you get the renter to take a close-up picture with a coin next to it? That would really help.

Never saw a termite that dark in color.

I have only ever seen the white/clear termites.
Google image seems to show them as black though (on multiple other pictures also).
Read the description of the termite pic and look at your picture, that might actually be a termite.

That appears to be a termite. Swarmers lose their wings after swarming. There should be clear, equal sized wings wherever he's seeing those at. Swarmers are reproductive and are black or brownish black in color, depending on species. If it's a Formosan, the wings will not be clear, like the Eastern subterrainian termites.
eta- swarm season is getting in full swing now as well. And seeing swarmers is not a bad thing. It doesn't mean there are workers doing damage yet, necessarily. But it does give you an indication that you have an area that needs addressing to prevent forthcoming damage.
