Was this a change in 2009?
If so, then that's how I got mine in TN while a resident of AL. I built mine before my Dad passed away in 2009. That would answer that.

My understanding is that 4473 was revised around that time to add the "other" option and a lot of the FFL's were unsure of the laws that applied to it. Many inquired to the BATF and that was the response letter that was issued.

I see judge's point (about purchase of a completed, usable at purchase, semi-auto rifle, encompassing the same part) being less restrictive, but many of the things that ATF does aren't always in line with public opinion. Since it could be made into a pistol, they wanted to make sure the more restrictive law applied. It is what it is
