Thoughts on a warning shot

Basically what i mean, you had a possible intruder or whatever on your property. He's caught by you and he's running away. Obviously we can't shoot to kill him running away but can one get in legal trouble to fire a warning shot directly into the ground to send the message that "hey fricker i got guns and shite don't frick with me type message". Obviously the best way for messages would be to email him but without that information, could one do this and not get into trouble with cops about firing a weapon in the subdivision etc.?

I see no problems with this. When the cops come, tell them that you shot in the general area of the intruder while he was facing you but missed. You should be in the clear after firing your warning shot.

I will admit, I thought this post was going to go a different direction but this aint too bad.

At least shoot into the ground that way noone gets killed. Just remember, what goes up must come down.

With my story the other day, i'm thinking the window guy took off in my backyard. Had i seen him running away back there and had my gun in hand, is it a horrible idea to maybe take a shot directly into the ground so this fricker will not want to come back. I wouldn't be shooting at him per say at all.

Sounds like the rewards are probably not worth the risk. You are opening a can of worms and the odds of getting the top back on are less than 50/50...

The only time your gun should be drawn or shot is when you are about to kill someone. Not warn, not injure, kill.

I get what you mean but that is far too black and white. What happens if you draw on someone with a knife and they back down? Do you still shoot because you already drew your weapon? Or is it like the samurai, if not their blood, yours.

The only time your weapon should be drawn is when you intend to use deadly force.

In Texas you can just shoot the SOB. Assuming he has your property while fleeing or it is night time.

Ok playing the devils advocate here..

You shoot into the ground, the yguy running away is either in the underground gun trade and now knows whose house to rob for said guns. Or what if he is just a thug POS with thug POS buddies, and thinks you are shooting at him when he may or may not have been just hiding in your bushes with no intent of harming you or yours. Now he wants retaliation, in the form of raping you and yours..

I never advocate for a warning shot. Even though the Vice President of the USA stated that you should fire two blasts, this could get you in tons of trouble. It is literally a felony to discharge a weapon in a residential area.

If the perp is far away from you and hauling arse, you have successfully ended the threat. There is no need to fire an errant shot at him as he runs away. Unless you can prove you were actually shooting at an intruder, you'll probably be facing a felony charge.

Now, if you are in your house, all bets are off. If he is in your castle, you do what you have to do to protect yourself and your family.

I have read way too many stories where warning shots have been detrimental to the good guys. I highly advise you don't do it.

So its better if he assumed i'm just an unarmed home owner? I see your points though and this was the point of the thread to find the pluses and minsues.
