I think being an accessory requires some positive action to assist the felon, I doubt inaction qualifies.

What about all the people in every major city in America who know of a crime being committed outside their house but don't come forward with it?

There are risks involved in opening your mouth. Say this is part of a bigger picture, say there are people above these two that ordered this bombing. These higher ups find out that this dude went to the police and that is how the bombers got caught. So now the higher ups come after and kill this guy.

Is that what would happen? I have no idea, but it is reason enough to keep quiet, isn't it? People keep quiet about crimes every day.


ETA: Most people have seen someone, a stranger or a friend, get in a car after too many drinks. If that person gets in a wreck, should you suffer consequences as an accessory? I mean, you watched them drive off but didn't call the police...

I don't see why this is even a question.

If he knew his friend bombed them should it be illegal for him to withhold that information? No. Should he let it be known? Yes.

Now at the same time, if I wasn't 100% sure that it was my friend, I would be hesitant to tell the FBI that I think my friend did it.

His personal opinion is that those who do not cooperate with law enforcement should not complain about crime. He has posted numerous times about the lack of cooperation by blacks in New Orleans with law enforcement and how it makes them more likely to be victims of crime.

But it is (if he knew they were the bombers).

Of course the FBI knew what they looked like by Tuesday morning and didn't tell the public for days. Within hours (if not minutes) of going public they had positive ID's.

Without seeing the video this is what I think...I actually thought about this when I first saw the pictures...what if you're wrong and you get your friend fricked up? And from what I've read the younger brother gave no indication in his life that this was a possibility...so you don't think your friend would ever do something like this, you see a grainy pic that looks like him....tough call IRL, easy call in unattached interweb hindsight.
