Do you consider humans technically animals? If yes, then...

Good point. What about penguins? They are monogamous. Are they aware or is that another instinct?

Guess you would have to ask the penguins.

My black lab mix is very aware that having sex with the sofa cushion is bad. So, she waits till we are out to rape the cushions. When I catch her in the act her facial expression is just like a human's "uhhh, I was just having a discussion with the pillow, dad."
Then, she slinks away.

How do you know dogs/cats aren't self aware? They seem pretty aware of themselves when danger comes around them. They understand many of our words. Many dogs have been known to do self-sacrificial acts.

I answered it already...no consent, no go. Without knowing an entity can give consent, you can't simply assume it does.

This isn't that hard...

I don't technically, and that goes back to my point. It's impossible to know the understanding a non-human animal has when it comes to such matters. As such it is impossible to gain their consent

They aren't.

Humans
Dolphins
Some Elephants

I think that's it for biological self-awareness.

I think a happy tail wag as they lick away that buttery goodness serves as a fair notification of their consensual state.

So mounting a smart slutty elephant and corn-holing it should be legal?

Interesting. If the animal initiates sexual activities it could be argued that they are giving consent, enthusiastically even.

If an 8 year old tries to initiate sex is that an indication of consent?

You're saying the animal is too dumb to understand what it's doing? They're effectively children mentally?

Dumb isn't the word I would use. More a lack of comprehension.

Obviously not. Self-aware does not equate to consent.

9 year olds are self aware; 9 year olds cannot consent.

An extreme libertarian would ask why not? Kids consent to all kinds of things.
