I can relate to this. In 1967 a year before I was born my Dad was hit head on by a drunk driver on a sunday morning. It happened about 5 miles east of Ponchatoula on Hwy 22. My Dad was traveling east when the drunk approached going west. He came over into my Dad's lane. Dad did everything he could to avoid it to the point of actually going off the shoulder and into the ditch but it was unavoidable. My Dad was pinned in the car with the dashboard and steering wheel against him. One brother of mine who was 2 at the time was sitting between my Dad and my other was on the passengers side. My Dad pinned my 2 yr old brother against the seat but that wasn't enough. The dashboard came back and hit him in the head killing him. ( Before the a-holes start commenting, car seats for kids were rare at this time ) My other brother came out fine. Dad had his knee and hip vertually destroyed. His hip and knee was wired together and he only has half of a knee cap. He was in the hospital for months. My Dad is pretty well known in our community and he had a number of friends come to him with info of where to find this guy. He actually went to the point of pulling up to a bar with a shotgun and intended to go inside and kill him. The only thing that stopped him was he worried about what would become of my brother and my Mom after he went to prison. On the drunk, he got off free as a bird. Drunk driving wasn't a big deal back then. But justice was served the worthless motherfricker sucked on the business end of a shotgun and blew his head off. Makes me all warm inside to know he is dead.

From Houston Chronicle article:
quote:
Tests showed Banda's blood alcohol was twice the legal limit when his Chevrolet Malibu rear-ended the Barajas' family's Ford 250 truck that had run out of gas on an unlit county road near Alvin, investigators said. The inebriated driver failed to swerve or even apply his brakes before plowing into the truck and crushing Barajas' sons, David Jr., 12, and Caleb, 11.

I've driven drunk many times in my life, but have no sympathy for drunk drivers. If I had hurt someone driving, no one would have had to kill me. Would have done it myself.

Too bad the laws on the books back me up. And those laws exist for a reason, hopefully that guy gets prosecuted for taking it into his own hands and murdering someone in cold blood.

I admit that I did not read the OP or the article, but if the father killed the driver at the scene of the accident, I don't know if I would call that cold blood. Again, I didn't read it. Please don't make me.

Agree. Very simple to make it look like trauma from the wreck. That said, six months suspended.

This guy will get manslaughter and probably serve less than 5 years. I admire what he did. eye for an eye

That's me. In fact, it is highly probable I would do it if the guy was driving drunk. If it was a justifiable accident, I would probably re-think the situation. But some drunk bastard killing two of my children? That bastard has just had his last drink and his last drive and his last breath. I wouldn't care what they did to me after that.

I'm not going to debate facts with b/c you are correct. But let me ask you this: Had it been your two children lying there dead and near dead would you have wanted to kill the guy?

Wanting to and actually doing it are two different things. Look, the drunk driver made a HUGE mistake. He didn't want to kill those kids. It was an accident that was a result of him being a moron and drinking and driving. The father should not have murdered him. Bottom line.
