Not necessarily. Especially if he inherited it. My BIL and his brother own a beachfront condo that they inherited. Because the brother and his wife are spendthrifts who live way beyond their means, they are being forced to sell it, since my BIL (who I think would like to keep it) doesn't have the necessary funds to buy his brother out.

Yeah. Its just fricking unbelievably difficult to think that to avoid repercussions from stealing, shes basically going to steal from me and avoid any consequences whatsoever to finance her living like a Hilton for a couple years basically Idk. Ill know by the end of the week for sure

The OP is back in the thread, so perhaps he can clarify, but if this woman is so leveraged that she's embezzling, I'm willing to bet she's already mortgaged the inherited property. Also, has it occurred to you that even if the property is unencumbered AND the sister transfers it to her brother, he may not have the capacity to repay the $200,000 loan? He may not even qualify because of existing financial obligations or his income level. Not as simple as you make it sound...

She's not avoiding all consequences. Unless she's a totally soulless individual, she'll never be able to look you in the eye again. Her relationship with you, her own blood, is forever altered. She's lost your trust, likely forever. Personally, I'd take the jail time over facing consequences like that with my family.

Screw that. At least in Louisiana that's a serious felony and she could do some real prison time. I'd let my sister do it. I'd also have her acknowledge the debt to me and have it civilly binding. Probably wont ever get it back but I wouldn't let my sister, thief or not, go to prison.

I stated earlier in the thread that this would be my position, also, if in the OP's shoes. However, if in the sister's shoes, I'd man up and accept society's consequences rather than screw over my own flesh and blood.

What is her plan for this? Is she asking you to go along with this and then promising repayment over time? Is should asking you to go along with this without promising repayment? What has she done since this became known to give you confidence that she will do whatever it takes to make you whole again...should you agree to help her out?

Chef are you on Dr. Phil right now? Dude's girlfriend stole nearly $500K to fund a failing business. Guess the show is all about how to deal with it and what the couple is going to do going forward. She stole $167k from the guy's mom, and siphoned off from his accounts to prop up her lifestyle. Thinking about it overnight and how much I dislike my own family, I don't think she's going to learn a thing and they won't be changing their lifestyle so there will be more issues in a few years.

Yes I believe even today he could get a loan for 50% of lands value. I have no idea if he could afford such a loan or not. Just pointing out that that would be the best way for him to keep the property whole and help his sister.

To be honest his lawyer should have let Chef know if he needed to put property in his sisters name to keep it from his ex-wife. If he did this not knowing if he needed he may have fricked himself.
