Now we are bringing the bar into the mix. If Im the bar owner and we sold alcohol could I be held liable in the shooting as well? In other words, my cooperation might not be the fullest.

Exactly. And Fontenot is underage. But the serving to someone under 21 would be the least of their worries if they got pulled into the mix.

I figured it was possible, so not sure how much it will weigh in here, but regardless of his actual BAC, I'm certain those around the defendant prior to the shooting will be deposed concerning his behavior. His actual BAC won't factor in as much as it would in a vehicular homicide case, IMO, but alcohol related facts could influence a jury on his charges.

I think it will only matter in the civil suit. I still believe that the charges will be reduced and they will not use his state of mind as evidence in the criminal case. They will not be able to show enough evidence that will be relevant. Unless they have video and some convincing physical evidence. Or they'll present the evidence and the defense will shoot it down immediately.

I think right now, there are few facts known publicly and almost all you're hearing is speculation.

I have seen some comments that are pretty close to actual events, IMO Good kids doing mischievous stuff. They end up "about" the wrong property. Resident is there and alerted by noise. Bad situation: multiple thefts before, weapon on property because of fear, family home. including little sister, possibly OTHERS, etc Confrontation, shots, dead kid. Kind of a perfect storm of bad events. After the shots, it seems everyone did as expected ,void the notification of the law by either party. Details should remain between the ones who need them at this point......lawyers, police, prosecutors. Bad tragedy for sure!

Same here, girl ran a red light supposedly and he hit her while he was drunk and killed her. Didn't do any time.

Everything I'm hearing is stacked against Fontenot. I'd think they really are going to need to appeal to the victims family for the reduced charges. I ate dinner with a couple of Fontenot's family and friends tonight that went to court today and they seem awfully optimistic. Tomorrow is going to be interesting.
