I don't understand all of the cons on this board who are outraged at the feds for taking away this guys freedom over eating crap but are all about the state taking his rights away for poling a dog. Loading him up with about 2/3 of his body weight and forcing him to walk across the desert or having some ugly Hispanic chick blow him. Which is crueler?

This really isn't that surprising.

1. It has NEVER been the case that all speech is utterly free from restraint. Defamation; yelling "fire" in a crowded theater, etc.

2. For decades, we have known that according to the Suprem Court, "obscenity" may be regulated. I am not a big fan of this exception because it is so slippery. It is the concept of "obscenity" - not pornography - that prompted the famous "I know when it when I see it" comment. But someone operating on the edge of the porn industry had better know that obscenity can be regulated and act accordingly.

Not the kind of thing I want prosecutors and law enforcement spending time on, but this is far from shocking.

I understand that bestiality is illegal in some states. But can someone tell me why one is tolerated and the other condemned? I mean they are both insanely disgusting acts.

Why do some on here say he should be let go for eating/smearing shite on someone, but if he fricked an animal (an act that presumably neither harms the person nor the animal), everyone goes bananas?

Is it truly because an animal can't "Consent" to the act? If the animal lifted it's tail and laid down, would that act then be considered consent?

Zach, a little interesting article to read was on the net on a dog in Italy that daily attends church where his owners funeral was held. He quietly sits through the services.

Don't you think that goes against what the 1st amendment clearly states?

At least prior to the 14th amendment and incorporation of the 1st, states could write into their own constitutions whatever exceptions they wanted to speech.

But let's just be intellectually honest here, the 1st amendment clearly states "Congress shall make no law ... abridging the freedom of speech." Why do you feel justified in allowing them to make some laws?

Congress didn't make those laws. That is how the Supreme Court interpreted the 1st amendment to be applied.

I a pretty big conservative and am 100% against this.

I don't believe in abortion, but it should be legal for those who do. I absolutely hate flag burning hippies, but they have a right to protest. I think homosexuality is disgusting, immoral, and plain freaking stupid, but I don't care if they get married and receive tax benefits.

When will people realize that not all people must live under the standard of morality and beliefs, just that all people deserve the same protection of their beliefs as they want of their own?

I agree with you on putting incorporation aside because the First Amendment applies to the states, too.

As for your question, this is just where logical extremists struggle to understand that things simply are not - and never were - so black and white. All of the examples mentioned - defamation, yelling fire in a crowded theater, and many more - were clearly understood as being within the legitimate power of government to regulate at the time the First Amendment was drafted. Some things are crystal clear, such as giving a speech favoring one candidate over teh other. Others are not so clear at all, such as figuring out whether you gave the speech at a time, in a place, or in a manner that the government could regulate (think bullhorns, late at night, etc.). So, the answer to your question is OF COURSE restrictions of any kind on speech appear to be in conflict with the literal wording of the First Amendment (as incorporated by the 14th) to the States.

and all I'm saying is that if you're going to have a litany of exceptions, then put them in the damn constitution/amendment.
