If it's a SBR like the one in the picture you can't just buy it. Takes a tax stamp and about 6 months plus $400 extra. If the barrel is shorter than 16" do not buy it without going through a SOT Class III or you could end up in the Fed for 10 years and paying 250K fine.

If he is just buying the upper then it is a non issue, he just can not place it on a lower with the stock attached. He can have it on a lower with just the buffer tube or to be completely safe have a "pistol" buffer on the lower.

It is A 300 AAC 14.5 inch barrel Upper with a Flash Suppressor pinned on.
