Ultimately there's no other way. Congress lacks the spine to do what needs to be done via constitutional amendment. It was always going to happen though, bigotry always loses.

I think more laws should be left up to the voters. Even if they vote along a line I don't agree with (see: last Presidential election) I would still rather more power be returned to voters. Same goes for drug legalization, abortion, prostitution legalization, etc.

I lean slightly to the Constitutional side, but it certainly is no slam dunk. I hope this doesn't blow up in peoples' faces as it did in NC. IMO basis of the case is different than interracial and polygamy precedents. Could go either way. Once it's decided though, it will be hard to undo, however the finding goes. I don't think we'd be here with CU, and the court might have been more favorable in 4-5yrs. But like I told Toddy and others, be careful what you ask for, you just might get it. June will tell.

I personally look at it this way. I don't really view it as a constitutional question. I think the govt should be out of the marriage license business ENTIRELY. But, given that it is, then I think the govt should not be in the business of telling adults whom they can marry. I also think polygamy should be legal among consenting adults. It's just the freedom lover in me. But that wasn't why I predicted what I did. I simply predicted that purely as a political watcher. I think they'll rule that way and Roberts will again be the key vote and will write the decision.
