I didn't say anything about the cop. What he did was wrong and he should be punished just as a normal citizen would in a similar circumstance. But when a drug dealer kills another drug dealer I'm generally not that upset about it.
Same applies here. Again, I'm making assumptions, but I bet this guy wasn't a model citizen.

Murder is VERY hard to prove, and requires proving that the defendant planned to kill someone in advance.
That isn't the case here at all.. NO ONE would be charged with murder under these circumstances. NO ONE. If he's charged at all, it will be second degree manslaughter, and even that depends on circumstances.
