Yes, lets suggest a straw purchase, which is illegal.

I thought it was not illegal for someone to buy the gun if it is legal for you to own the gun in the first place. It is only illegal if you could not purchase the gun legally and someone bought it for you anyway...

From Wikipedia:

"In the context of United States federal gun laws, a straw purchase is defined as any purchase from a dealer holding a Federal Firearms License where the buyer conducting the transaction is acting as a proxy for another person. The law does not distinguish between someone who is purchasing on behalf of a person who legally cannot purchase or possess a firearm, and one who is not."

So, from my understanding, giving money to someone who can get the discount, and having them buy it for you would be considered a straw purchase. However, once someone purchases a firearm for themselves (and checks "Yes" in the first box), they are free sell it to anyone, or give it away as a gift, given that the person you are giving or selling to can legally possess a firearm.

As long as you do not give someone money beforehand, I don't think it's a straw purchase according to the letter of the law. If they decide to sell their gun to you, they are within their rights. I think that this law is mainly in place to stop people from buying guns for felons, not people trying to score discounts. I remember reading about an FFL holder in Alabama who got arrested last year because he was allowing people to make straw purchases. A guy would fail the background check, and he would just suggest that his wife, who was standing right next to him, buy it for "herself."

Hopefully someone with law enforcement or ATF knowledge can comment on this, because I'm not sure if it's something that anyone truly understands.

Yea I can't see how someone legally purchasing a firearm then deciding to sell it to someone else is illegal, so long as the purchasee is legally permitted to posses a firearm. In LA guns don't even have to be registered.

But I'd be curious to hear a professional opinion on this matter

Technically, it would be. Realistically, the odds of being charged with a crime in such a situation would be pretty slim (since ATF is supposedly out chasing "gun walkers").

Probably best to avoid even the appearance of a straw purchase.

How would anyone be able to prove a straw purchase? Or where do you go wrong? Getting money ahead of time to purchase a gun for someone?

Just bought a gen 3 with a PD serial number and night sights. $395. It's used but looks brand new except for a small mark where a light was clipped on the rail. The guy had 7 of them and does appointment only. Lemme know if you needn't the info.

It would be hard to prove, but intent would come in to play. If you think the PO would take the stand in a federal case and say that he wasn't purchasing it for you, when he's looking at a plea bargain, you can try it. But it's not for me. I'm not a fan of jail time

Pay him a few bucks for his old one and let him upgrade to a brand new one....

Looks like the guy took the ad down. I did find two other ads though (neither are Gen 4 though):

Glock 22 Gen 2 - $400 OBO. Not sure if you are interested but maybe you could bring the price down into the middle $300s.

Glock 22 Gen 3 - $425. Once again, maybe you can bring him down a little to $400.
