Because that's what a justice system is for. You want to make child molestation punishable by death ok let's do that but 1 guy doesnt get to decide what equals justice for an society.
This guy has a good defense for heat of the moment type passions and shouldn't get anything serious.
There are reasons though we don't let individuals hand out justice as their own judge jury and executioners.

I see it this way. This guy saw his daughter being molested and in my eyes that means "great bodily harm". Therefore, deadly force is legal. Good job Dad.

DHR (or a similar authority) will do an investigation with the child. detectives will interview the father and possibly the child. they will check under his nails for traces of her skin. they will take the child to a SANE/SART nurse. lots of ways to get evidence. most of it will be circumstantial, but thats good enough

yeah, if he is on the sex offender registry then this is a closed case. but that info would probably already be available and reported. a big question i have (and i'll admit i havent read the story) is where did the alleged attempted molestation occur? if a strange man came into the home of the child, then the father has a really strong case. if the deceased had a legitimate reason for being in the child's presence, then thats a different story.

He shouldn't do jail but he should definitely be required to go through a long therapy and rehab period.

Why? That he actually desires proof that this is what happened instead of a guy beating another guy to death and just making an excuse for it?
I don't have kids myself, but if this guys story is true, then I can't fault him at all. You can't just assume he's telling the truth and give the father a pass.

And on the bright side you get to find out your best friend or family member is a sicko perv that likes to frick a 4 y.o.
I have 2 kids under 5...if I walked in on this the result would be the same. If I ended up doing time i would do it with a smile on my face knowing I protected my kid from the single most traumatizing thing that can happen to a 4 y.o.
