Shooting a deer swimming across the bayou

Let's say said deer is swimming across a navigable waterway and you pull up in your boat and shoot said deer in the head with your shotgun on the way back from duck hunting.
What's the law on this?

the only think i can think that would make it illegal is if the motor was running.

Were you wearing hunter orange, do you have deer tags, were you using legal gun and ammo (#4 steel shot, i dont think is legal for deer) and if you had buckshot you were illegal for ducks, were you paddling your boat?

Not sure about the deer being in the water, but you can't use motorized transportation to aid you in the taking of deer. This would be the same as running one down with a truck or 4 wheeler. The only way it might be legal is if the motor is off and the boat comes to a complet stop.

Technically it might be illegal but I would probably chance it. I dont think many wardens would fuss over a legal deer shot during the season by someone with a license.
ETA: A boat in the water and a car/ 4 wheeler off a road are two different things IMO.

On the afternoon of January 23, Louisiana Department of Wildlife and
Fisheries Enforcement Division agents cited two Hebert men for allegedly
killing a deer while it was swimming. Danny Emmons, 49, and Dolyn Duchesne,
43, were both cited for taking a deer illegally from a boat or while
swimming.
Sr. Agent Joe Chandler Jr. made contact with the men as they were attempting
to take their boat out of the water. A large eight-point buck was in their
boat. Both men stated that Duchesne was operating the boat, and Emmons shot
the deer while it was swimming.
The illegally taken deer was seized and donated to a needy family in Tensas
Parish. Emmons was also issued a civil citation for the restitution value
of the deer.
The penalty for taking a deer illegally from a boat or while swimming is a
fine of up to $350, jail for not over 60 days, or both, plus court costs.
Also assisting in the investigation was Sgt. Larry May.
