Odd isn't? She was trying to speak to adults, who can control their emotions, to be shut down by adolescence that can't control their emotions. And we let adolescence control the country and the narrative.

I mean, they lean left, but credit to ACLU for standing up (at least partially) to the deranged masses on their side. They're taking tons of shite from the freak show left for the audacious statement that college campuses should not engage in effective viewpoint-based censorship.

Coulter canceled her own speech. What do you want them to do? You can't sue Berkeley where Coulter "voluntarily" canceled the speech.

That's why I phrased it as "voluntarily." I understand there is more to it, but what relief could the ACLU request in court? "Please make Berkeley put on this speech that Coulter has said she no longer wants to give?"

Legally there just isn't a room for a case unless Coulter is pushing the issue. They stuck up for the NRA and Rush, but only where those groups are pushing the issue.

I love the downvoted when I'm just stating a non-political fact about our legal system.

Gotcha. I really was off topic and not focused on the ACLU.

That said.

If the KKK started threatening every venue blacks spoke at and the local government response was to tell the black leaders they were on their own......i suspect the ACLU would figure something out

Let me get very technical here. To bring a lawsuit, the party bringing the suit must have been harmed. This is called Standing and is required to get relief in federal courts (Standing significantly more complicated, but let's go with this for now). The ACLU in these cases is not the one harmed in their cases. What is actually happening is someone else is bringing suit and the ACLU is bankrolling/supporting the litigation (think Peter Thiel behind Hogan).

In this Coulter would be the one with standing to sue. She puts out a statement and says she is canceling. Now regardless of the reason why she did that, she has undermined her own standing to sue. She is now on the record saying the opposite of "I want to do X and Berkeley/the PD is preventing me from exercising my First Amendment right."

Where she blows up her own chances in court what is the ACLU supposed to do?

like I said. If local governments told black people that it was up to them to make the call as to whether they were going to protect their supporters because the government was going to stand down you bet your arse that lawyers would be tripping over themselves calling the black people in question.

If you're trying to tell me that the ACLU would sit back and not try to make equal protection claims when the government was choosing repeat choosing to not protect a subset of people from violent threats I'm just going to sit here and laugh.

That doesn't even remotely pass the smell test

I mean we really taking the position that the only recourse for blacks in such a situation would be to hold the speech and watch their supporters getting beaten or worse before they can do anything?

And let's not even just talk about blacks.

Let's see some governments tell organizers of Gay Pride parades that the police will be standing down if openly threatening violent protesters show up. Let's see what the reaction is if Government basically tells the organizers that is there a call as to what to do. But oh by the way you can't bring your own armed security team
