What if ACB votes to KEEP the ACA

Once she’s confirmed. I hope to god she doesn’t, but what if she stands with the libs. Will the pos senators apologize? Does she have a documented statement on the ACA?

ACA, in SOME form, is assuredly gonna hang around...rather than an outright repeal, I think they're going to tweak it and add to it and cut from it...I doubt it will be fully be eliminated.

The COURT is not supposed to do that.

this is all theater on the dems' part. they dont care about the aca or any of those photos they put up. its all about power and focus groups.

they literally have no soul or morals.

It will depend on the aspect or argument that is being debated.

It's a concern of mine because my insurance went from $600 to $1600 month with a $7000 deductible for a family of 4.

But nothing can be worse than what the scum Roberts did to us and legitimized it instead of making Congress fix their error.

I think a lot of the fearmongering on ACA today by the Dems was to scare voters away from Trump, motivate their base, and also to hopefully influence ACB in her future decisions by bashing her with this.

she wrote a scholarly article critizing the decision. She called ACA, SCOTUScare. said Roberts pushed the ACA beyond its definition to uphold it.

If it is unconstitutional it's unconstitutional and gets struck plain and simple.

Of course not. I never suggested it would be the court doing these things.

I'm not quite certain what the case is that's to come before the court shortly.

We'll see. She'll be confirmed... Worried about DJT...I HOPE it's unfounded fear...

The ACA is poorly written law but it's not unconstitutional. So since ACB says she wants to uphold the constitution in the strictest sense, then she would presumably vote to not strike it down.

The only part of the law that is even questionable by constitutional rules are the mandates, and I think Congress correctly applied their power to tax. Even if it took some linguistic stretching to turn a penalty into a tax =)

ACB disagrees. she says its unconstitutional and was only decided to be constitutional due to Roberts using excessive linguistic gymnastics. Presumably she would vote to strike an unconstitutionally written law down.

ETA - the individual mandate is currently decided to be unconstitutional, SC is hearing an appeal to that decision.

And there's not.

The only thing that made it law was the individual mandate. The individual mandate is unconstitutional.

It's gone. But it's probably going to still be around a very long time if we expect Congress to actually do their jobs and come up with a rational replacement for ACA.

This isn’t how ACB does her job. She doesn’t vote for or against something. She will interpret the law, as it pertains to the case, and she will rule accordingly. There might very well be times when she rules in favor, and times when she rules against, the ACA.

As long as the SC rules based on the Constitution, then I can't really be upset with whichever way they rule on cases. If the collective body interprets the ACA to be in line with the US Constitution, then so be it.
