To those who think the Garner case cop should've been indicted,On what basis? We all agree it was not an intentional killing, so we must be talking criminal negligent homicide, right? Go on record with what charge and why. If negligence, say how he was negligent. That is, say whether a reasonable person in the officer's shoes would have foreseen that garner would die from such a brief choke. I am not seeing it, but you all are, so I want to know. I know the first answer will be "chokeholds are banned," and I have addressed that and will again if necessary.
How about, "I didn't know the gun was loaded?"

He should have been indicted on negligent homicide. And subsequent found not guilty in trial. And then fired from his job.
The real issue here is not a criminal case. It's the nanny state laws in New York. A guy selling loose cigarettes poses a threat to NO ONE. These type of laws are difficult to enforce because they simply don't make sense to our basic instincts. People will naturally be more pissed and unruly when you attempt to enforce them. How would YOU react when the Gestapo came after you for barbecuing in your own damned yard? Or selling someone a cigarette? They're victimless and they harm no one. But I'm sure it all sounded good on paper when the "we know what's best" politicians enacted these laws.

And that would be just a tragic. But I don't see this as a racial issue. Other than that I'd expect there to be more black guys selling loose cigarettes than white guys. And maybe that's a misguided stereotype, but it's the way I see it. Not racial at all. It's a dickhead cop issue.

You can see how these cop gang incidents escalate. A bunch of guys standing around just waiting to pounce. Adrenaline pumping sky high until the switch is flipped and all move in in unison for the take down. Jockeying for position to get the choice cut which is usually the knee (with full body weight) on the jaw. The other guys....dis-appointed that they didn't get the prime cut of the kill over compensate with the old knee grinder to the legs or back. Of course, there is the one lucky fella who is in position to get that back arm bar and pop that shoulder out of socket as the pain delivery apparatus in his brain is red lining. All to "apprehend" a man who likely could not get off the ground unassisted without major effort and exertion. But procedure....you know.

Regarding the race issue, I think cops are dicks to everyone, however, they're more likely to resort to force more quickly with the blax. If I were a member of that community I'd be a big advocate for the end of the drug war/legalization and removal of any laws driving everyday legal products into the black (pun intended?) market....anything to reduce contact with the police. Right now there are too many laws which the cops can capriciously enforce whenever they want against whoever they want.
