Can anyone shed some insight into what this election meant for the state of Tennessee? All my friends on facebook from there are bemoaning the results with comments that are basically "Tennessee as just moved back into the stone age for women's reproductive rights"

Seeing as I don't keep up with that state very much, da fuq are they talking about?

Hyperbole from the "war on womans" people? No way.

From what I understand, people cannot get an abortion in TN now unless they are a resident.

That's it? Really? Odd law for sure, but not some catastrophe.

Hyperbole.

They amended their constitution to give the legislature the right to regulate abortion. That's it.

Amendment 1 is what they are talking about

quote:

What the amendment would do: If passed, the amendment would have no immediate effect on abortion in Tennessee. However, lawmakers would have more ability in the future to pass restrictions that the state Supreme Court has previously ruled were unconstitutional. A “yes” vote would give lawmakers this ability. A “no” vote would leave the state constitution unchanged. If enacted, Tennessee would become the fourth state in the nation that has an abortion amendment in its constitution. The other three states are Arkansas, Colorado and Rhode Island. What measures could lawmakers enact if Amendment 1 succeeds? Examples of measures that lawmakers and others have spoken publicly about include: • A waiting period before a woman seeking an abortion can obtain one. • A requirement that doctors give women specifically worded information about abortions and fetal development crafted by lawmakers. • A ban on abortions past a certain stage of fetal development. • A requirement that abortion clinics meet the stricter standards of ambulatory surgical centers where typically more complex medical procedures are performed. • An end to exceptions to abortion restrictions for women who are victims of rape or incest, or in cases in which a woman’s health is at risk.

There was a 2000 Tennessee Supreme Court case that ruled restrictions on abortion as unconstitutional under the State Constitution.

The amendment allows the restrictions to be passed again.

Real medieval policies like:

Requirement that second-trimester abortions be performed in hospitals as opposed to clinics.
48-hour waiting period before receiving an abortion requirement.
Requirement of physician-only counseling before an abortion is performed.
Exemption to requirements only in circumstances where a woman’s life is threatened.
Mandate to prove residency.

Tennessee amended their Constitution to take power away from judges and gave it back to the legislature

I didn't know it was, either, until our preacher said Sunday morning that a large percentage of abortions were for out of state people.
