Because a lot of the republicans are really democrats. It would be better to have 41 rel conservatives in the senate then the 49 we have now.

They don’t have a slim majority. They have a filibuster proof majority with rinos. Think about it. Every major Biden Administration initiative has been passed with a strong bipartisan support in the senate. All of it.

Case in point. The Senate just passed the House bill funding Ukraine 79-18. Democrats have 51 with the 2 “independents “. Eff every one of them.

If RvW was deemed unconstitutional by the Supreme Court how can congress pass a law reinstating RvW that is unconstitutional?

The Supreme Court did not say that Congress or the States were prohibited from passing legislation with respect to abortion rights. It said that The Court in Roe wrongly decided the case on what amounted to 4th Amendment grounds. Dobbs just basically says that each state is free to determine its own policy . It does not prohibit Congress from getting involved via the legislative process.
