Has the signature petition for incorporation of St George been submitted? No.
Has the petition for annexation by the Mall, et al, been submitted? Yes.
Using the logic of the Hayride article, if an area petitions to be annexed into an existing city, as the Mall and BRGH have already done, and a small number of property owners don't want to be annexed within the area petitioned, all they would have to do to stop the annexation process is to file a signature petition for incorporation of their small area. And that would freeze the annexation process that has already begun?
That is against all common sense.

So what happens if the signatures are turned in prior to the other parts of the mall filing for annexation?
Then some of the mall would be part of St George and other parts would be BR??? That is, if the Nov election was a success...

You really think an election will be a success? They can't even get people to sign a petition that they are willing to hand deliver.

I don't claim to know the legal ins and outs of the incorporation/annexation process, as Hayride apparently claims to do.
However, after I saw this thread, I read through the 3 main sections of the Louisiana Revised Statues pertaining to an unincorporated area requesting incorporation and there was nothing in them which stipulates a "freeze" on annexation requests because an incorporation petition has been filed.
It would have been nice if the Hayride author had cited a statue or court case which supports its assertion.

I think if it goes on the ballot that it would have a good chance of passing... Who is going to be more inclined to show up to vote, those in favor or opposed?
They need to get 25% of SG residents to sign it... frick, its hard to get 25% of residents to show up to vote. I don't think that is indicative of the feelings of the area.

Depends. Pretty sure the people who don't want to pay higher taxes may have a problem with a new city.
having trouble getting the petition sign should tell you something. Most people probably don't want to incorporate.
To wake up one day and all of a sudden you live in a new town with new taxes and ordinances?
If they wanted that, they'd probably not have moved into unincorporated areas.

Plus the business owners who, like the MoL and the other businesses which have exercised their legal right to not be forced to be in a new St George city while the SG folks are trying to make it impossible for them to be annexed into Baton Rouge, don't want the unknown of how much their property taxes would increase in a new city and school district.
